Terms of Use
Last updated: 12 October 2026
These Terms of Use (the “Terms”) govern access to and use of ProfBloom, published by Guillaume NAVY, sole trader registered under SIRET number 84376461400031, with registered offices at 78, Avenue des Champs-Élysées, Bureau 326, 75008 Paris, France (“ProfBloom”).
ProfBloom is an online service intended for teaching professionals and students (the “Service”).
Creating an Account is subject to prior acceptance of these Terms. That acceptance takes place when the Account is registered or activated.
These Terms are supplemented by the Terms of Sale, which govern the paid subscription, and by the Privacy Policy, which describes the processing of personal data.
ProfBloom reserves the right to amend these Terms. Users holding an Account are notified of any substantial amendment by email at least thirty (30) days before it takes effect.
Definitions
In these Terms, the following terms have the meanings set out below:
- Service: ProfBloom together with all of its features.
- Teacher: any individual or legal entity holding a teacher Account.
- Student: any person holding a student Account.
- User: a Teacher or a Student indifferently.
- Teaching content: any teaching content created, imported or generated within the Service.
- Account: the space reserved for a User, accessible after authentication.
Access to the Service
The Service is available online, subject in particular to maintenance operations, technical incidents and events of force majeure.
Access requires an internet connection and a recent browser. Connection and equipment costs remain the User's responsibility.
ProfBloom endeavours to keep the Service available but cannot guarantee uninterrupted availability. Scheduled maintenance is announced in advance wherever possible.
Accounts and registration
Teacher account
Registration as a Teacher takes place from the Service. It requires a valid email address and acceptance of these Terms.
ProfBloom may refuse a registration made with a temporary or disposable email address, in order to protect the security and integrity of the Service. The person concerned is informed and may apply again with a permanent address, or contact ProfBloom if they believe the refusal is mistaken.
Authentication is passwordless, by single-use link sent by email, by passkey, or by signing in with a Google or Microsoft account. The Teacher is responsible for the security of the means giving access to their Account.
Teachers are recommended to enable two-factor authentication from their Account settings.
Student account
A Student Account is created solely following an invitation sent by a Teacher. The Student must accept these Terms when activating their Account.
Students have their own Account and access the content and features made available to them within the Service.
Minimum age
Users must have reached the age allowing them to use the Service on their own under the legislation applicable in their country of residence.
Students who have not reached that age may only access ProfBloom under the responsibility of a parent or legal guardian, with their consent, involvement, supervision and continuous presence. The Account must then be created and used under the responsibility of that parent or legal guardian.
Account security and use
Each Account is reserved for its holder and may not be shared between several people. Users are responsible for the security of the means giving access to it.
Users must notify ProfBloom without delay of any unauthorised use of their Account, at the address given under “Contact”.
Roles of the parties and student data
The Teacher is responsible for the personal data they enter, import or process concerning their Students in the course of their activity. It is for them, in particular, to ensure that such processing is lawful and to comply with the obligations applicable to them.
Where ProfBloom processes data solely in order to provide the features requested by the Teacher, ProfBloom acts as a processor and processes that data on their instructions.
ProfBloom acts as a controller for the data necessary to manage teacher and student Accounts. ProfBloom also acts in that capacity where teaching data is attached to the Student's Account in order to ensure continuity of their progress tracking and to personalise the content and features offered to them.
ProfBloom may also use previously anonymised data to analyse and improve the Service and, in time, to train its own artificial intelligence models, under the conditions set out in the Privacy Policy. That data no longer allows Users to be identified.
The arrangements for processing personal data are detailed in the Privacy Policy.
Teaching content and intellectual property
Content of the Service
The Service, its structure, interfaces, texts, illustrations, visual identity and code are protected by the applicable intellectual property rights.
Any reproduction, extraction or reuse, in whole or in part, of those elements outside the normal use of the Service is prohibited, save with ProfBloom's prior authorisation or where the law permits it.
Content created by the Teacher
The Teacher remains the holder of the intellectual property rights they hold in the Teaching content they create within the Service.
They grant ProfBloom, for the time necessary to provide the Service, a non-exclusive and royalty-free licence to host, reproduce, technically adapt and display that content, in particular to the Students for whom it is intended.
That licence is strictly limited to the operation and provision of the Service. ProfBloom does not use Teaching content imported or manually created by the Teacher to develop or train artificial intelligence models.
The Teacher warrants that they hold the necessary rights in the content they import or use within the Service.
Content generated by artificial intelligence
The Service offers features for generating Teaching content with the assistance of artificial intelligence.
Content generated by artificial intelligence may be inaccurate, incomplete or unsuitable. It is for the Teacher to check its accuracy, relevance and pedagogical suitability before using it or sharing it with their Students.
ProfBloom claims no intellectual property rights in the content generated for the User. The Teacher may use, modify and incorporate it into their own Teaching content, subject to third-party rights and applicable regulations.
ProfBloom may reuse the generated content, provided that it contains no personal data, confidential information or protected element supplied by the User, in order to improve the Service, offer it to other Users, and develop, train or improve its own artificial intelligence models.
Student work
Work produced by the Student within the Service remains under their control and is accessible to the Teacher where necessary for monitoring their progress.
ProfBloom processes it under the conditions set out in the Privacy Policy. Data derived from that work may, once anonymised, be used to analyse and improve the teaching features of the Service and, in time, to train ProfBloom’s own artificial intelligence models, under the conditions set out in the Privacy Policy.
Payments between Teacher and Student
The Service enables the Teacher to receive payments from their Students for the lessons they deliver. Payment processing is handled by a third-party payment service provider.
ProfBloom is neither the seller nor the provider of the lessons delivered by the Teacher. The contract relating to the lessons is concluded directly between the Teacher and the Student. ProfBloom provides only the technical features enabling, among other things, their booking and payment.
The Teacher sets their rates, cancellation terms and refund arrangements. They are responsible for delivering their services and for the tax, social security and accounting obligations applicable to them.
Any complaint relating to a lesson, its content, its cancellation or its refund must be addressed to the Teacher concerned.
Payments are subject to the payment service provider's controls and procedures, in particular regarding identity verification, fraud, unauthorised payments, disputes, and anti-money laundering and counter-terrorist financing. The provider may request further information, refuse or suspend a transaction, or restrict certain features in accordance with its own terms and legal obligations.
Where a request or dispute relates to the payment processing itself, the User may need to contact the payment service provider directly.
Payment processing is subject to the terms of the payment service provider concerned.
The Teacher’s public page and reviews
The Service provides the Teacher with a public page that they are free to publish or not. The page is never published without an action by the Teacher, who can take it down at any time.
The Teacher chooses the information shown on their public page and is solely responsible for it. They warrant that it is accurate, in particular their qualifications, prices and availability, and that they hold the necessary rights to the texts, photos and videos they publish there. The obligations set out in the “User obligations” article apply to the content of the public page.
The Teacher decides whether their page may be offered to search engines. After that setting is turned off or the page is taken down, its removal from search results depends on the search engines concerned and ProfBloom cannot guarantee how long it will take.
A Student who has taken at least three confirmed lessons with a Teacher may leave a review of that Teacher. ProfBloom checks this condition but does not review the content of reviews. The review is published on the Teacher’s public page, with the Student’s first name and the initial of their surname, only after it has been approved by the Teacher, who chooses which reviews appear on their page. The Student can edit or withdraw their review at any time.
A review must reflect a genuine experience and comply with the User’s obligations. ProfBloom may remove a review or a public page that breaches these Terms, under the conditions of the “Breaches and suspension” article.
People who write to the Teacher or request a booking from their public page pass on their contact details to the Teacher. The Teacher undertakes to use them only to respond to their request.
User obligations
Users undertake to use the Service in accordance with its purpose, these Terms and applicable regulations. In particular, they shall not:
- infringe the rights of third parties, in particular intellectual property rights, privacy and image rights;
- create, import, share or distribute content that is unlawful, defamatory, insulting, hateful, violent, discriminatory, pornographic or contrary to human dignity, or any sexual content involving minors or liable to harm their safety or integrity;
- use the Service to harass, threaten, exploit, deceive or harm another person;
- use the Service for fraudulent purposes, impersonate a third party or knowingly provide false or misleading information;
- attempt to access data, Accounts or areas they are not authorised to access, circumvent security measures, introduce malicious software or interfere with the operation of the Service;
- systematically extract or reuse the data or content of the Service, in particular by means of unauthorised automated processes;
- use the Service to send unsolicited communications or for any unlawful activity;
- transfer, lend, share or resell access to their Account.
Breaches and suspension
In the event of a breach of these Terms, ProfBloom may ask the User to remedy the situation within a reasonable time.
In the event of a serious breach, or where immediate action is necessary — in particular in cases of fraud, unlawful activity, or harm to the security of the Service, to personal data, to the rights of third parties, or to the safety or integrity of a minor — ProfBloom may immediately suspend all or part of access to the Service.
ProfBloom may terminate the Account where a serious breach warrants it, or where the User fails to remedy the situation after being informed of it.
Suspension or termination resulting from a breach attributable to the User gives rise to no refund of sums already paid, subject to applicable legal provisions.
Liability
ProfBloom is bound by an obligation of means in providing the Service and endeavours to ensure its security, proper operation and availability.
The Teacher remains responsible for the Teaching content they create, import, select or share, as well as for the teaching methods they use and their suitability for their Students.
Content generated by artificial intelligence may contain errors. ProfBloom does not warrant its accuracy, completeness or pedagogical relevance. It is for the Teacher to check it before using it or sharing it with their Students.
ProfBloom cannot be held liable for the contractual relationships between a Teacher and their Students, nor for the consequences of any use of the Service contrary to these Terms or to applicable regulations.
ProfBloom cannot be held liable for unavailability or malfunction attributable to the internet network, to the User's equipment, to a third-party service or to an event of force majeure.
No provision of these Terms has the object or effect of excluding or limiting ProfBloom's liability where it cannot lawfully be excluded or limited.
Teachers are recommended to regularly export the data they wish to keep independently, in particular their accounting data.
Connected third-party services
The Service allows Users to optionally connect or enable certain third-party services, in particular an electronic calendar or a payment service.
Use of those services is also subject to their own providers' terms. ProfBloom is not responsible for their availability, operation or any changes to them.
Duration and termination
These Terms apply throughout the period of use of the Service.
Teachers and Students may request deletion of their Account at any time from the Service settings.
Deleting a Student's Account entails anonymisation of the data concerning them held by their Teachers. For any request relating to that data, the Student should contact the Teacher concerned directly, as they are the controller for its processing.
Deleting a Teacher's Account does not entail deletion of their Students' personal Accounts. It ends the relationship between the Teacher and the Students concerned and entails deletion of the data processed solely on the Teacher's behalf, under the conditions set out in the Privacy Policy.
Deleting a Student's Account does not necessarily entail deletion of the data the Teacher keeps under their own responsibility, in particular where they are required to retain it in accordance with their legal obligations.
Deleting an Account entails deletion of the data associated with it, according to the periods and arrangements set out in the Privacy Policy.
A request to delete an Account is final. Certain data may nevertheless be retained for the periods set out in the Privacy Policy, or where the law requires it.
It is for the User to export beforehand any data they wish to keep, where that option is offered to them.
Termination of the Teacher's paid subscription is governed by the Terms of Sale. Deleting an Account does not entail any refund of sums already paid, subject to applicable legal provisions.
Governing law and dispute resolution
These terms are drafted in French and translated into English for information purposes. In the event of any discrepancy between the two versions, the French version prevails.
These Terms are governed by French law, subject to any mandatory provisions applicable to the User by reason of their country of residence.
In the event of a dispute, Users are invited to contact ProfBloom first in order to seek an amicable solution.
Where they act as a consumer, the User may, after a prior written complaint to ProfBloom has remained unresolved, use free of charge the consumer mediator to which ProfBloom belongs:
